1. Reasons for Amendment
This Amendment to the Enforcement Rule modifies the subordinate law in accordance with the amended Act on Welfare of Persons with Disabilities and addresses complaints, etc. from organizations and associations for persons with disabilities.
2. Major Provisions
A. Specify the types of sex-related counseling services for persons with disabilities and newly prescribe details and methods of sex education for users of residential facilities for persons with disabilities, matters concerning the establishment and operation of a central sign language center, procedures for preliminary announcement in the event that center establishment or operation is outsourced, etc. in accordance with the amended Act on Welfare of Persons with Disabilities (amended on August 8, 2023; enforcement date: February 9, 2024).
B. Modify the definitions of the types of welfare facilities for persons with disabilities so as to enable daytime care facilities for persons with disabilities to provide such opportunities as activity-oriented programs and learning support to persons with disabilities who require assistance to go about their daily lives and engage in community-based activities (attached Table 4 of the Enforcement Rule of the Act on Welfare of Persons with Disabilities).
C. Modify the definitions of the types of welfare facilities for persons with disabilities so as to enable mobility support centers for persons with disabilities to provide visually impaired persons, etc. with a mobility service, identify visually impaired persons, and offer such services as rehabilitation counseling, orientation and mobility/braille/informatization and other education, daily activity training, etc. (attached Table 4 of the Enforcement Rule of the Act on Welfare of Persons with Disabilities).
D. Request organizations and associations for persons with disabilities to change the names of welfare facilities for persons with disabilities (daytime care facility for persons with disabilities → daytime service facility for persons with disabilities, Korean sign language interpretation center → sign language interpretation center, mobility support center for persons with disabilities → living support center for visually impaired persons, etc.) (attached Tables 4 and 5 of the Enforcement Rule of the Act on Welfare of Persons with Disabilities).
E. Tighten the vocational training instructor ratio requirement (from 10-12 students per instructor to 8 students per instructor) to account for the increase in the percentage of persons with developmental disabilities working at vocational rehabilitation facilities (attached Table 5 of the Enforcement Rule of the Act on Welfare of Persons with Disabilities).
F. Reflect the addition of “upper limb orthotics” to the list of specializations in qualifying examinations for prosthetists/orthotists (attached Table 6 of the Enforcement Rule of the Act on Welfare of Persons with Disabilities).
G. Reflect findings from the inspection of state administration regarding the formulation of individual support plans for persons with developmental disabilities (2022, National Assembly member Kang Sun-woo) to newly insert an “application for the formulation of an individual support plan for persons with developmental disabilities” as a service application item in the “Person with Disability Registration and Service Application Form” (attached Form 1-4 of the Enforcement Rule of the Act on Welfare of Persons with Disabilities).
H. Delete matters concerning the submission of a copy of a bankbook specified in the “Person with Disability Registration and Service Application Form” as the bank account required when registering as a person with a disability or applying to reissue a disability registration certificate can be verified through the system (attached Form 1-4).
I. Address concerns over excessive exposure of information and other complaints made over the years by deleting the photograph field from the person with disability registration certificate (attached Form 9 of the Enforcement Rule of the Act on Welfare of Persons with Disabilities).
